of Well-Known Marks
of Well-Known Marks: adopted by WIPO on 29 September 1999. It establishes criteria for determining whether a mark is well known. These are (a) the degree of knowledge or recognition the mark enjoys, (b) duration, extent and geographical area of use of the mark, (c) duration, extent and geographical area of any promotion of the mark, (d) duration and geographical area of any registration or application for registration of the mark, (e) the reord of successful enforcement of rights in the mark and (f) the value associated with the mark. The Recommendation also contains detailed provisions for dealing with conflicting marks (reproduction, imitation, translation or transliteration of a mark liable to create confusion with the well-known mark).
